What are the steps for getting a document notarized?

There are several steps that must be taken before a document can be notarized. First, the Notary Public will need to verify the identity of the person signing the document. In addition, the Notary will also confirm that he or she doing the signing knows the meaning of what they’re signing. Here are the steps that will typically take place before a document can be notarized.

  • The individual who will be signing the documents must present valid identification (including a valid government-issued photo ID along with another form of identification) to the Notary
  • The Notary will then make sure the individual who is signing the document understands what they are about to sign
  • The notary then bears witness to the signer’s signature
  • Once the individual has signed the document, the notary will place his or her stamp to seal the document. With that complete, the document is now notarized.

When a document is officially notarized, it means the same as if the individual who signed the documents was swearing under oath in a court of law. The individual who signed the documents is attesting to the facts contained in the document to be true.

Certain documents do not allow a notary to bear witness, including separation agreements or any type of agreement that might fall outside of a notary’s area of practice.

Why is a notary required for certain documents?

  • It must include a notarial “certificate,” which may be present on the document itself or on an attachment

When a notary is witnessing a signature on a document, the following applies:

  • If the notary certificate says “subscribed and sworn/affirmed to me,” then it must always be signed in the presence of a notary
  • If the document has already been signed, the notary can just ask the person to sign the document again, either above or below the previous signature
  • An acknowledgement does not need to be signed in your presence. The person who signed the document is obligated to appear before you and acknowledge that they are the signer and that they did in fact sign the documents.
